🚛 ¿CONTRATAS EL TRANSPORTE? Entonces hay algo que deberías comprobar antes de cargar.

En logística, una pregunta aparentemente sencilla puede cambiar completamente las responsabilidades:

¿Quién contrata el transporte?

No es lo mismo actuar como cargador efectivo que como cargador contractual. Y esta diferencia puede afectar a la documentación, al DECA, a la responsabilidad sobre el transporte y a la actuación que debe seguirse ante determinadas incidencias.

En TCC hemos desarrollado un protocolo práctico para nuestros clientes que parte de una pregunta clave:

¿TCC contrata el transporte?

A partir de ahí, analizamos:

🔹 Si el transporte es nacional o internacional.

🔹 Si corresponde DECA o CMR.

🔹 Quién asume la responsabilidad como cargador.

🔹 Si la matrícula del vehículo está registrada en MITMA.

🔹 Qué documentación debe aportar el transportista.

🔹 Cuándo debe comunicarse una incidencia al cargador contractual.

🔹 Y, especialmente, cuándo NO debe cargarse un vehículo.

⚠️ Antes de cargar, una comprobación sencilla puede evitar un problema

Si la matrícula aparece como NO REGISTRADA, nuestro protocolo contempla verificar la documentación y solicitar, cuando corresponda:

✔️ Tarjeta de transporte en vigor (MDLE / MDP).

✔️ Justificante de alta de la matrícula en el registro.

✔️ Alternativamente, otro vehículo habilitado.

Además, existen situaciones en las que la carga no debe realizarse, como vehículos sin documentación obligatoria, conductores sin identificación, vehículos manifiestamente inseguros o mercancías incompatibles con el vehículo.

La clave no es únicamente “¿podemos cargar?”

La pregunta correcta es:

“¿Estamos cargando de forma segura, documentada y con las responsabilidades correctamente identificadas?”

Who contracts the transport?

Acting as an effective shipper is not the same as acting as a contractual shipper. This distinction can affect documentation, the DECA, transport responsibilities and how incidents should be handled.

At TCC, we have developed a practical protocol for our clients based on one key question:

Does TCC contract the transport?

From there, we assess:

🔹 Whether the transport is domestic or international.

🔹 Whether a DECA or CMR applies.

🔹 Who assumes responsibility as shipper.

🔹 Whether the vehicle registration is recorded in the MITMA register.

🔹 What documentation the carrier must provide.

🔹 How to handle incidents with the contractual shipper.

🔹 And, above all, when a vehicle should NOT be loaded.

⚠️ A simple check before loading can prevent a bigger problem

If the vehicle appears as NOT REGISTERED, our protocol provides for checking the relevant documentation and requesting, where applicable:

✔️ A valid transport card (MDLE / MDP).

✔️ Proof of registration in the relevant register.

✔️ Alternatively, another authorised vehicle.

There are also situations where loading should not take place, including vehicles without mandatory documentation, unidentified drivers, manifestly unsafe vehicles or goods incompatible with the vehicle.

The key question is not simply:

“Can we load?”

It is:

“Are we loading safely, with the correct documentation and with responsibilities clearly identified?”
